Terms of Service
These Terms of Service govern your access to and use of Nepselens, including the website, dashboard, analytics tools and AI assistant. By signing in or using the service, you agree to these Terms and our Privacy Policy.
1. The Service
Nepselens provides market intelligence and analytics for Nepal Stock Exchange data, including broker activity, company fundamentals, dividends, mutual-fund information, charts and an AI assistant. The service is operated under the name Nepselens by Yama Technologies Pvt. Ltd., Tirtha Ghar, Srijananagar, Bhaktapur-01, Bhaktapur, 44600, Nepal.
We may improve, replace or discontinue individual features at any time. We do not guarantee that every feature will remain available or that data will always be complete, accurate or uninterrupted.
2. Accounts and Google Sign-In
Access to account features currently requires a Google account. When you sign in, Google provides us with your Google subject identifier, email address, name and profile picture, subject to your Google permissions. You are responsible for maintaining the security of your Google account and for activity under your Nepselens account.
You must provide accurate account information and must not impersonate another person, share access in a way that defeats account limits, or use another person's account without permission.
3. Eligibility
Nepselens does not impose a strict minimum age. We recommend that users be at least 16 years old. If you are below the age of majority in your jurisdiction, you may use the service only with the consent and supervision of a parent or legal guardian.
You must be legally able to enter into these Terms and must comply with the laws that apply to you.
4. Plans, Features and Billing
Nepselens may offer free and paid plans, including plans billed for a fixed term and one-time lifetime access. Current plan descriptions, features and applicable charges are shown at checkout.
We may add, modify, suspend or remove plans, features and charges over time. Charge changes apply prospectively. We will provide reasonable notice where practicable before a material change reduces the benefits of an active paid term, and we will not retroactively reduce a paid term except where necessary for legal, security or operational reasons.
The lifetime plan, when offered, may be limited in quantity and is subject to the terms shown at purchase. Removing or changing a plan does not entitle you to a refund except as described below or required by law.
5. Billing, Renewal, Cancellation and Refunds
Paid plans are prepaid for the billing period shown at purchase. Unless the checkout explicitly states otherwise, fees do not automatically renew and you must renew or cancel before the end of the current term. Some plans may require a manual payment arrangement; in that case, access is activated only after we verify the payment against your order reference.
If automatic renewal is offered, the renewal amount and cancellation instructions will be shown at checkout. Cancelling stops future renewal; access generally continues through the end of the paid period.
Fees are non-refundable except where required by applicable law or where we expressly state otherwise. We may correct billing errors and may suspend paid access while an unpaid or disputed amount is investigated.
6. Acceptable Use
You agree not to:
- use the service for unlawful, fraudulent or harmful activity;
- scrape, crawl, copy or resell the service or its data at scale without written permission;
- bypass authentication, rate limits, access controls or paid-plan restrictions;
- interfere with the service, its infrastructure or other users;
- upload malicious code or attempt to gain unauthorised access;
- use the AI assistant to violate another person's rights or applicable law.
7. Market Data and No Financial Advice
Nepselens is an information and analytics service. It is not a broker, investment adviser, portfolio manager or exchange. We are not affiliated with or endorsed by the Nepal Stock Exchange unless expressly stated.
Market data is compiled from public disclosures and third-party sources. It may be delayed, incomplete, unavailable or contain errors. Charts, ratios, broker statistics and AI-generated commentary are for research and information only and are not investment, legal, tax or accounting advice. You are solely responsible for your investment decisions.
8. AI Assistant
The AI assistant generates responses using dashboard tools and a third-party AI model provider. Generated output may be inaccurate, incomplete or out of date. Verify important figures independently before relying on them.
Do not submit passwords, payment credentials, private keys or other highly sensitive information to the assistant. Your prompts and related tool results may be processed by the configured AI provider under its own terms and privacy policy.
9. Intellectual Property
The Nepselens name, branding, interface, software and original content are owned by or licensed to Nepselens. We grant you a limited, revocable, non-exclusive right to use the service for your own research, subject to these Terms. You may not copy, redistribute, sell or create a competing service from our content except as permitted by law.
You retain ownership of content you submit. You grant us the limited rights needed to process it, provide the service and maintain security.
10. Third-Party Services
The service depends on third-party providers for Google authentication, hosting and databases, AI processing and, when enabled, payment processing. Their services may be subject to separate terms and privacy policies. We are not responsible for third-party websites or services we do not control.
11. Availability, Suspension and Termination
We aim to keep Nepselens available, but we do not guarantee uninterrupted or error-free operation. We may temporarily suspend access for maintenance, security, legal or operational reasons.
We may suspend or terminate your access if you materially violate these Terms, create a security or legal risk, or fail to pay valid fees. You may stop using the service at any time and may request account deletion as described in the Privacy Policy.
12. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the service is provided as is and as available, without warranties of merchantability, fitness for a particular purpose, non-infringement or accuracy.
To the maximum extent permitted by law, Nepselens will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data, or investment losses arising from use of the service. Our aggregate liability for claims relating to the service will not exceed the amount you paid to Nepselens in the twelve months before the claim, or NPR 5,000 for free-plan users. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify Nepselens against claims and reasonable costs arising from your misuse of the service or violation of these Terms or another person's rights.
13. Governing Law and Disputes
These Terms are governed by the laws of Nepal. Subject to any mandatory consumer protections that apply to you, disputes will be subject to the courts located in Kathmandu, Nepal.
14. Changes to These Terms
We may update these Terms to reflect changes to the service, law or our operations. The updated version will be posted on this page with a new effective date. If a change materially affects your rights, we will take reasonable steps to notify you. Continued use after the effective date means you accept the updated Terms.
